Overview#The Tony Ferguson Weightloss Guarantee (‘the Guarantee’) will be available to new customers for the first week once they have joined the Tony Ferguson Weightloss Program (‘the Program’). Tony Ferguson guarantees that they will lose weight in the first week of commencing the Program provided that the customer strictly follows the guidelines of diet provided to them by the Tony Ferguson Weightloss practitioner. If the customer does not lose weight, they will be compensated with a supply of a second week of sachets at no cost to the customer.
Minimum BMI Requirement#For a customer to qualify for the Guarantee, they must have a BMI of 25 or more. If the customer has a BMI of less than 25, they are not classified as overweight and therefore do not need to be on the Program.
New Customers Only#The Guarantee will only be available to new customers joining the Program. It will only guarantee that they will lose weight in the first week of the Program. The Guarantee is not available to existing or lapsed customers.
Compliance#Customers must comply with the Program guidelines that are outlined to them by their Tony Ferguson practitioner and given to them in printed material when they join the Program. Prior to Commencement of the Program#All new customers must have a consultation and a weigh-in with a Tony Ferguson Weightloss practitioner before they commence the Program. The customers weight will be recorded at the initial consultation and any weight loss will be measured against the customers weight at the end of the first week.
Availability#The Guarantee is only available to customers at their original point of purchase, being the store where the customer had their initial consultation, weigh-in, purchased their membership and their first week’s worth of sachets.
Claims#Any claim that an individual customer has against the Guarantee because they have not lost weight within the first week of being on the Program must be made within 10 days of the customer purchasing their membership and joining the Program.
Compensation#If a customer has complied strictly with all of the Program guidelines outlined by the Tony Ferguson Weightloss practitioner; has returned for their weigh-in at the end of the first week; and the practitioner has determined that the customer has not lost any weight at all since commencing the Program, compensation will be provided to the customer in the form of 14 sachets, being supply of a second week’s worth of sachets at no cost.
